#1: Chapter I Amendment: Public Empowerment and Democracy Act of 2007
Existing Bylaws require that student petitions to place various initiatives or recall measures on an AS ballot be signed by 5% of the entire student body for an initiative and referendum and 15% of an elected officer’s constituency for a recall of that officer
The proposition amends Chapter I of the AS Bylaws to change the required number of signatures to present initiatives or recall measures as follows:
– To initiate changes to Chapter II of the A.S. Bylaws, 5% of the votes cast for all candidates for the AS president during the previous general election
– To initiate changes to Chapter I of the AS Bylaws, 10% of the votes cast for all candidates for the AS president during the previous general election
– To place a referendum on the ballot, 5% of the votes cast for all candidates for the AS president during the previous general election
– To recall an elected officer, 25% of the number of votes case in the previous election for that office
Voting “YES” means that you are in favor of changing the required number of signatures on petitions for initiatives and recalls proportional to the voter turn out for the previous ASI General Elections.
Voting “NO” means that you are not in favor of changing the required number of signatures on petitions for initiatives and recalls proportional to the voter turnout for the previous ASI General Elections.
#2: Chapter I Amendment: Ratification of Proposed Amendments to Chapter I
Existing Bylaws require that changes to Chapter I of the AS Bylaws be approved by a 2/3 majority of those members participating in a referendum election. The proposition would reduce the number of votes required for ratifying proposed amendments to Chapter I of the Bylaws from 2/3 to a simple majority of those voting during a referendum election.
Voting “YES” means that you are in favor of changing the required number of votes needed to ratify proposed amendments to Chapter I of the Bylaws from 2/3 to a simple majority of those voting.
Voting “NO” means that you are not in favor of changing the required number of votes to ratify proposed amendments to Chapter I of the Bylaws from 2/3 to a simple majority of those voting.
#3: Chapter I Amendment: Technical Corrections to Chapter I
Chapter I of the AS Bylaws includes an article describing the process for amending Chapter I bylaws. This clause currently requires that ALL changes to Chapter I Bylaws “be placed on the ballot of the next general election.” This includes such minor changes as grammatical corrections, changes in the titles of positions, etc. Through this referendum, the AS Senate is seeking the approval of the student body to amend the Bylaws so that certain amendments to Chapter I NOT require placement on the ballot.
1. Amendments to correct grammatical or syntactical errors
2. Amendments to update or correct the titles of persons or positions referenced herein, or
3. Amendments that are determined necessary to ensure that Associated Students complies with the laws of the State of California.
Voting “YES” means that Article VIII of Chapter I of the AS Bylaws will be amended as indicate above to allow certain types of amendments without an election.
Voting “NO”means that Article VIII of Chapter I of the AS will not be amended and will continue to require placement on the ballot for all Chapter I amendments.
